Welcome to AgilePress (agilepress.solutions). These Terms & Conditions (“Terms”) govern your access to and use of the AgilePress platform, services, and any deployer plugins (collectively, the “Service”), operated by AgilePress Solutions LLC (“we”, “us”, or “our”), registered in New Mexico, USA.

By registering for an account, purchasing a subscription, or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

1. Description of Service

AgilePress is a productivity tool designed for WordPress professionals. It allows users to create, curate, and deploy collections (“Stacks”) of WordPress plugins, themes, code snippets, and configuration files (Vault) to third-party WordPress installations. AgilePress acts strictly as a bridge and orchestration tool; it does not host, distribute, or modify the source code of the plugins or themes installed.

2. Limitation of Liability and “As Is” Provision

Our Service is provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for excellence, we cannot and do not guarantee that the Service will be 100% error-free or uninterrupted.

AgilePress is intended to be used during the initial development phase of a WordPress website. We act merely as a deployment conduit. We do not evaluate, audit, or guarantee the safety, compatibility, or functionality of any plugin, theme, or code snippet you choose to include in your Stacks.

You acknowledge and agree that AgilePress Solutions LLC shall not be held liable for:

  • Any website crashes, fatal errors, database corruption, or data loss on your or your clients’ websites resulting from the deployment of a Stack.
  • The quality, security, or performance of third-party software downloaded from the official WordPress.org repository or from external URLs you provide.
  • Any direct, indirect, incidental, or consequential damages or financial losses arising from the use or inability to use our Service.

The decision to install specific software and snippets rests entirely with you. You are solely responsible for ensuring you have proper backups of any destination website before deploying an AgilePress Stack.

3. User Content and Zero Tolerance for Abuse

AgilePress does not host the source code (e.g., .zip files) of any plugins or themes. We only store the metadata (names, URLs, public/private notes, and code snippets) and small configuration files (e.g., .json or .xml settings) uploaded to the Vault.

However, you agree not to use the Service to orchestrate the installation of malicious software. You are strictly prohibited from:

  • Adding external URLs that link to malware, spyware, or viruses.
  • Adding URLs that link to “nulled”, pirated, or illegally distributed premium plugins/themes.
  • Storing malicious executable scripts within your code snippets or Vault files.

We reserve the right to review Stacks and immediately suspend your account and delete your data without prior notice or refund if we determine you are using the Service for malicious, illegal, or unauthorized purposes.

4. Fair Use and System Integrity

To ensure a fast and reliable experience for all users, your use of the AgilePress API and platform must comply with fair use principles. You are prohibited from:

  • Using automated bots, scrapers, or scripts to aggressively query our platform or API.
  • Attempting to bypass our paywall, stack limits, or security measures.
  • Overloading our servers with unreasonable requests that degrade the performance of the Service for other users.

AgilePress reserves the right to temporarily throttle, limit, or permanently suspend any account (including Pro and Agency accounts) that exhibits abusive behavior towards our infrastructure.

5. Intellectual Property

You retain ownership of the data you input into your Stacks (your curation logic, notes, and specific code snippets). However, AgilePress Solutions LLC retains all right, title, and interest in and to the Service, including the platform’s code, design, logos, and the deployment plugin architecture.

6. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New Mexico, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

7. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through a notice within the platform. Continued use of the Service after any such changes constitutes your consent to such changes.
